In Ada County State District court on Tuesday, Kinner's defense chose to stand silent, meaning the judge entered the not guilty plea on Kinner's behalf.

Kinner was indicted Aug. 7 on first degree murder of 3-year-old Ruya Kadir as well as eight counts of aggravated battery, one count of burglary and two counts of aggravated assault and weapon enhancement.

Police say he was staying at the Wylie Street Station apartments when he was asked to leave after residents became concerned with his behavior, which he did peacefully. He returned with a knife and started attacking people, according to authorities.

Jury selection for Kinner's upcoming trial will begin Jan. 3. The judge also approved the court bringing in up to 300 potential jurors.
